The Intercept Media and the non profit Freedom of the Press Foundation filed in the southern district of New York, asking the court to block the plan. Their argument is that the president stands to benefit financially by supplying government information capable of moving markets to whoever is willing and able to pay his personal company. The programme they are challenging was announced in July. Trump Media and Technology Group said it would give paying subscribers early sight of Trump's Truth Social posts for up to 100.000 dollars a month, under the name Truth API, and described it as designed for organisations most affected by the cost of a delay in information. The Intercept says that blocking equal access to official information violates the First Amendment and the rights of journalists and citizens. Ben Muessig, its editor in chief, put it directly: Trump is trying to enrich himself by privatising government information he has no right to sell, and they do not intend to let it pass. The service already has customers. Trump Media chief executive Kevin McGurn told the company's results call on Monday that more than ten companies have signed Truth API agreements, generally for between 60.000 and 100.000 dollars a month. He did not name them, but said the company is in advanced talks with major news organisations and with developers of large language models. What makes the information valuable is what Trump has used the platform for. He has announced senior administration appointments there, bombing campaigns in Iran and new tariffs. His recent posts on the war in Iran moved markets and the oil price, and fed into inflation over recent months. An advance look at that output, before everyone else sees it, is a tradeable asset. The commercial backdrop is a company under pressure. Trump Media had briefly planned to spin Truth Social off as a standalone business before reversing in June after what it called further evaluation.
